Woman Arrested for DWI after Blocking Intersection

Around 12:12 AM on August 13, 2023, Sergeant Matthew Clark and Patrolman Richard Christie with the Shrewsbury Police Department observed a 2015 Nissan Sentra obstructing the intersection at Shrewsbury Avenue and Sycamore Avenue. Sergeant Clark activated his emergency lights and instructed the vehicle to move. After the driver steered her vehicle northbound on Shrewsbury Avenue, he initiated a traffic stop and she pulled over in front of World Jeep. They advised dispatch of the traffic stop and proceeded to make contact with the driver, who was identified as Meredith Miller.

Patrolman Christie first approached the vehicle and asked her where she was coming from. As Sergeant Clark asked Meredith for her documentation, he detected the odor of alcohol. When Meredith was asked if she had been drinking, she admitted to consuming alcohol earlier that night. Based on his suspicion of impairment, Sergeant Clark asked Meredith to exit the vehicle and perform field sobriety exercises.

Sergeant Clark started with the Horizontal Gaze Nystagmus (HGN) test, and he observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. He also observed vertical nystagmus. The second field sobriety exercise was the Walk and Turn test. During the Walk and Turn test, Meredith took six steps in each direction instead of the nine she was instructed to take, turned improperly, and failed to count. The last field sobriety exercise was the One Leg Stand test. During this exercise, Meredith displayed a lack of balance and failed to raise her foot in the proper fashion.

Based on her erratic driving, her admission to consuming alcohol, and her inability to adequately complete the field sobriety exercises, Sergeant Clark placed Meredith under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law and Meredith was transported to the Shrewsbury Police Department for further processing. At police HQ, the Standard Statement for Motor Vehicle Operators was read to Meredith and she agreed to submit breath samples.

Sergeant Miller administered the Alcotest machine after Meredith agreed to submit breath samples for testing. Her Alcotest results indicated a BAC of 0.187%, which is more than double the legal limit of 0.08%. Once the officers were finished with processing Meredith, she was released to a friend after he signed the Potential Liability Warning form on her behalf. Sergeant Clark issued her the following summonses: Operating under the influence, reckless driving, careless driving, and obstructing passage of other vehicles

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
