Cop’s Ex-Wife Gets Arrested for DWI on Thanksgiving Day

Around midnight on November 23, 2023, Patrolman Nicholas Turi with the Sea Bright Police Department observed a Nissan swerving and being driven in an erratic manner on Ocean Avenue. He initiated a traffic stop and asked for her documents. The driver, who was identified as Esa, told Patrolman Turi that she was coming from Ocean House Tap and Grill. Patrolman Turi asked Esa if she had consumed alcohol, and she admitted to doing so. To assess whether she was impaired, he asked Esa to recite the alphabet from “A” to “Z,” and she was able to to so satisfactorily. Patrolman Turi then returned to his vehicle to run her license and requested another unit on scene.

After Patrolman Ty Manning arrived on scene to assist, Patrolman Turi asked Esa to exit the vehicle and perform field sobriety exercises. Patrolman Manning started with the Horizontal Gaze Nystagmus (HGN) test, but he was unable to get an accurate result because Esa kept moving her head. The second exercise was the Walk and Turn test, and Esa did not touch heel-to-toe on each step. The final exercise was the One Leg Stand test, and Esa was unable to raise her foot in the proper fashion and she ended the test before she was instructed to put her foot down. Patrolman Manning attempted the HGN test once again, but he was still unable to get any results.

Based on her erratic driving, her admission to consuming alcohol, and her inability to adequately complete the field sobriety exercises, Patrolman Turi placed Esa under arrest for driving under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John’s Law and Esa was transported to the Sea Bright Police Department for further processing.

At police HQ, Patrolman Turi read the Standard Statement for Motor Vehicle Operators to Esa, and she agreed to submit breath samples for testing. Patrolman Manning administered the Alcotest machine, and her results indicated a BAC of 0.04%, which is below the legal limit of 0.08%. However, Patrolman Turi told Esa that she would still be cited for driving under the influence based on her inability to adequately complete the field sobriety exercises.  

After they were finished processing Esa, she was released to a sober adult at 1:48 AM after she signed the Potential Liability Warning form on her behalf. Patrolman Turi issued Esa the following summonses: Operating under the influence, reckless driving, and traffic on marked lanes

The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
