In order for a dismissal to be fair, the employer needs to have a valid reason for dismissing the employee, and the intended dismissal must also be procedurally fair. Fairness = Reason + Process.

The most frequently used "Reason" to dismiss employees is 'misconduct'. Therefore, it is important for employers and employees to understand the "Procedure" which must be followed prior to an employee being dismissed for 'misconduct'. Failure to comply with the process amounts to an unfair dismissal process.

The required procedure in the South African legal framework is highlighted by the Code of Good Practice: Dismissals (Schedule 8) which is discussed in this video. Employers should refrain from unfair dismissal processes.
