Employment-Based Third Preference (EB-3) visa
Employment-Based Third Preference (EB-3) visa is one of the employment-based immigrant visa categories in the United States. The EB-3 visa is intended for foreign workers with skills in occupations for which there is a shortage of U.S. workers. There are three subcategories within the EB-3 visa:
EB-3A - Skilled Workers:
Requires a minimum of two years of job experience or training.
The job must be a position that requires at least two years of training or experience.
EB-3B - Professionals with Bachelor's Degrees:
Requires a U.S. bachelor's degree or a foreign equivalent.
The job must be a profession that requires a minimum of a bachelor's degree.
EB-3C - Unskilled Workers:
For jobs that require less than two years of higher education, training, or experience.
The position must be a job that is unskilled, meaning it requires less than two years of training or experience.
The EB-3 visa process typically involves the following steps:
Labor Certification: The employer must obtain a labor certification from the U.S. Department of Labor (DOL). This involves demonstrating that there are no qualified U.S. workers available for the position and that hiring a foreign worker will not adversely affect the wages and working conditions of U.S. workers.
Form I-140, Immigrant Petition for Alien Worker: Once the labor certification is approved, the employer must file Form I-140 on behalf of the foreign worker with U.S. Citizenship and Immigration Services (USCIS).
Visa Number Availability: The availability of visa numbers depends on the individual's priority date, which is established when the I-140 petition is filed. The priority date is compared to the dates published in the monthly Visa Bulletin.
Adjustment of Status or Consular Processing: Once a visa number becomes available, the foreign worker can proceed with the final stage of the process, either by adjusting status within the U.S. (if eligible) or through consular processing at a U.S. embassy or consulate abroad.
