A motion to dismiss is not only a term used in foreclosure cases, but basically means the same thing in most lawsuits. What you're aiming for is getting some evidence or case dismissed and taken out of court. With foreclosure cases, a motion to dismiss will be looking for one party to admit or deny the allegations of the other side and they have 20 days to do so. If the other party misses the 20 day deadline, the motion to dismiss is immediately granted. A motion to dismiss can be very helpful as it gives your side a hearing in which the court can decide whether or not your case has merit or not and if it should continue through the court system.
