INTRODUCTION TO RETRENCHMENTS

When an employer contemplates dismissing employees for operational requirements (retrench employees), the appropriate procedure must be followed. The procedure to be followed is highlighted in section 189 of the Labour Relations Act 66 of 1995, as amended ("LRA").

In this video I explain the process that the employer needs to follow. Failing to comply with the appropriate procedure may result in the dismissal or retrenchment being procedurally unfair.
