This video is a step by step to drafting a Section 189(3) Retrenchment Letter. This is the letter that is used to invite the employees (or their representatives) to the first retrenchment consultation. In accordance with Section 189(3) of the Labour Relations Act of South Africa, the notification must contain (at least) the 10 points listed in the Act. In this video is discuss each one, with recommendations of how to detail it. I share recommendations, common mistakes, pitfalls to avoid and more to help Employers start the retrenchment process off on the right foot. I also include examples and ways of phrasing the information.
