Off Duty State Police Officer Arrested For DUI By Fellow State Police Officer

On the morning of December 3rd, 2023, at approximately 1:31 am, I, Patrolman R. Lujan III was on patrol in the City of Albuquerque, County of Bernalillo, and State of New Mexico. I was driving a marked New Mexico State Police unit, in a uniform, and clearly displaying my badge of office number 184. While on duty, I was traveling westbound on Interstate 40 near milepost 164, when I observed a black- colored pickup traveling in front of my patrol unit. While the vehicle was in motion, it accelerated and began traveling at a high rate of speed. The vehicle appeared to be exceeding the posted speed limit. Due to my observations, I activated my front (Eagle) radar device and looked at the display, which read ninety (90) miles per hour. The posted speed limit in that particular area is sixty-five (65) miles per hour. then positioned my patrol unit directly behind the vehicle and engaged my emergency equipment and conducted a traffic stop on the black-colored Dodge pickup truck bearing a New Mexico temporary registration on Interstate 40 near milepost 161. Upon exiting my patrol unit, I approached the vehicle on the passenger side and met with the male driver of the vehicle. I introduced myself, informed him the reason for the traffic stop and requested his driver's license and vehicle information (Insurance and Registration). The male driver was identified as being Mr. Edgar Madrid, date of birth 1992 (Defendant). The Defendant was observed to have blood shot watery eyes, and I detected a strong odor of an alcoholic beverage emitting from inside of the vehicle. The Defendant was unable to provide me with his driver's license or valid proof of insurance for the vehicle. I then requested the Defendant to exit the vehicle and to meet with me outside at the rear of the vehicle. While speaking with the Defendant outside in front of my patrol unit, I was still able to detect the strong odor of an alcoholic beverage emitting from the Defendant's person/breath. I was able to reconfirm that his eyes were bloodshot watery. I asked the Defendant if he consumed any alcoholic beverages prior to driving. The Defendant advised that he had consumed at least one (1) beer prior to the traffic stop. Based on my observations and admission from the Defendant, I had him perform a series of Standardized Field Sobriety Tests (SFST's). Upon completion of all SFST's, based on my training and experience and my observations of the Defendant's driving (Vehicle in Motion), I observed the Defendant to display signs of impairment and determined the Defendant was unable to continue to operate a motor vehicle safely. At 1:40 am, the Defendant was arrested for Driving while under the influence of intoxicating liquor, which he was then placed in steel handcuffs that were fitted and locked for his safety. I read the Defendant the New Mexico Implied Consent Advisory (Full card to include the consequences of refusal) and he verbally refused to be tested. I checked the interior of his mouth to ensure it was free and clear of any foreign matter, which was clear at approximately 1:42 am. He was then transported to the New Mexico State Police office in Albuquerque for processing. After a 20-minute deprivation period (0142-0213 hours), the Defendant's information was entered in the currently certified IR8000 breath-instrument, and the Defendant at that time did not provide any breath samples and allowed the instrument to time out with no sample introduced. No secondary test was requested. A tow inventory was completed pursuant to my department policy. Shelps Towing arrived and took possession of the vehicle. A check of Defendant's driving history in NCIC returned as a driver's license. The Defendant had no prior DWI convictions, making the arrest his first offense. The Defendant was released to the Bernalillo Metropolitan Detention facility staff upon the completion of the paperwork where he was booked and incarcerated without incident.
