A Phoner Fight

The plaintiff says her friend, the defendant, smashed her phone and ruined her trip by getting belligerently drunk and violent during their Miami vacation, so she’s suing. The defendant admits he and the plaintiff got into a fight and he threw the phone, but he insists he shouldn’t have to pay just because he got drunk during the trip.
