In a big relief for homebuyers, the Supreme Court has held that despite the Real Estate Regulation and Development Act of 2016, they can approach the consumer courts for complaints. These include receiving compensation and refunds from such companies for delay in getting possession of their homes. In the 45-page judgement, the apex court said that Section 79 of the Real Estate Regulatory Authority Act, 2016, does not stop consumer forums to hear pleas of home buyers seeking justice under the provisions of the Consumer Protection Act. The SC order certainly comes as a matter to rejoice for home buyers who are facing delay in getting possession of their dream homes.
