On the show today we are going to talk about an issue that has been a matter of debate for years, and which impacts the harmonious coordination between the three organs of our democracy - the Legislature, the Executive and the Judiciary. We are going to discuss the issue of potential judicial overreach - an issue raised by Vice President M Venkaiah Naidu at the All India Presiding Officers' Conference last week. While speaking on the theme of ‘harmonious coordination’ among the judiciary, executive and legislature, the Vice-president raised concern over a spate of recent judicial pronouncements, which according to him, give a distinct impression of “judicial overreach”. He cited some examples which include judicial pronouncements on the Diwali fireworks, cess on registration and movement of vehicles from the National Capital Region through Delhi; banning use of vehicles of certain make after 10 or 15 years; monitoring police investigations etc. saying these have led to questions over whether the judiciary is entering the domains of the legislative and the executive. He also referred to incidents of the Executive and the Legislature exceeding their brief, as prescribed in the Constitution. On Discussion Today, we will analyse the concerns raised by the Vice President over disharmony between the three organs, incidents of potential overreach by the Judiciary, and how can a harmonious relationship be maintained among the three vital pillars of our Democracy.
