The Freedom of Information Act (FOIA) allows you to obtain your information stored by a US governmental agency. Having worked for the Immigration and Naturalization Service (1976-82), I can not stress enough the importance of knowing what is in your immigration file before submitting an application for an immigration benefit.
This can be very important when you have had some dealings with the agency in the past. Even more important if you were in deportation proceedings before an Immigration Judge.
What if you had a hearing before an Immigration Judge in the past and are not sure what evidence was presented by the Government or how you answered a particular question? This could be crucial to your ability to qualify for an immigration benefit.
What if you were stopped at the border or questioned at an airport? What did the Immigration Officer write in your file?
In many, many cases, my advice is to obtain a copy of your immigration file from the government before you submit an application for immigration benefits. It is the prudent thing to do, and could save you years of time and thousands of dollars in attorneys fees.
Compare it to a game of poker. You have some good cards, but how do you know how much to bet since you cannot see your opponent's cards. In the immigration world, you can see your opponent's cards before you place your bet!
This gives you such a huge advantage, that is a wonder that not everyone submits a FOIA request before applying for immigration benefits.
