Public intoxication is a crime that occurs when someone is in a public place, such as a sidewalk, street, or park, and is intoxicated on alcohol or drugs. The prosecutor does not need to prove a specific level of intoxication, such as a blood alcohol content (BAC), and the mere appearance of being drunk is enough for a conviction.

However, a defense can be made if the person can demonstrate that they were not actually drunk, for example, if they were very tired or have a neurological condition that makes them appear drunk. Typically, in Oklahoma, police will not arrest someone for public drunk if they are walking home from a bar and not causing problems. However, if they are causing trouble or pose a safety threat to themselves, they may be arrested.
