A Division bench of the Andhra Pradesh High Court has struck down the earlier order by a single-judge bench regarding Mandal Parishad Territorial Constituency (MPTC) and Zilla Parishad Territorial Constituency (ZPTC) elections in the state.
The MPTC and ZPTC elections in Andhra Pradesh will now be held on April 8 as per schedule.
Earlier on Tuesday, a single-judge bench of the Andhra Pradesh High Court had stayed the notification of the State Election Commissioner on MPTC and ZPTC elections.
The state election commission had filed an appeal against the interim stay order passed by the single-judge bench.
Newly-appointed State Election chief Nilam Sawhney had earlier issued a notification announcing MPTCs and ZPTCs polls. The polling was scheduled for April 8 and the counting of votes on April 10.
Justice U Durga Prasad granted an interim stay on petitions filed by the Bharatiya Janata Party (BJP) and the Jana Sena, challenging the April 1 notification of the State Election Commission, resuming the parishad election process that was deferred in March 2020, news agency PTI reported.
The petitioners contended that the SEC issued the fresh notification in haste, in clear violation of the Supreme Court verdict that set a four-week time line for enforcement of the model code of conduct ahead of the polls.
"Immediately upon assuming charge as the State Election Commissioner, Nilam Sawhney issued the notification for resumption of the parishad election process in total disregard to the Supreme Court order," the petitioners was quoted by PTI as saying.
The Telugu Desam Party (TDP) had termed the elections "unlawful" and announced that the party will boycott the polls.
TDP chief Chandrababu Naidu hailed the Andhra Pradesh high court's stay on Parishad elections as a vindication of his party's decision to boycott the elections.
"The stalling of the Parishad polls by the court was a clear victory for the Ambedkar constitution," said Chandrababu Naidu.
The BJP also hailed the high court's order to stay the MPTC and the ZPTC elections.
Tamil Nadu BJP chief Somu Veerraju tweeted: "In a massive blow to the YS Jagan Mohan Reddy government and exposing the misuse of state machinery, Hon'ble AP High Court stays the notification of State Election Commissioner on MPTC and ZPTC elections in Andhra Pradesh
