Have you ever come across the “183-day rule” and wondered what it's all about? In this video, I dispel the myths and misunderstandings surrounding this rule.

As an international tax expert, I explain that many people confuse tax and immigration law, even though the two areas have different rules for the number of days you have to spend in a country. For example, you have to be present in Switzerland for 183 days per year to keep your residence status, but after just 90 days you are liable to pay tax there.

I also clarify that even with taxes, there are several confusing rules. Many double taxation treaties state that employees who are temporarily posted abroad remain taxable in their home country as long as they do not spend more than 183 days a year in the posting country. Some people mistakenly think that if you spend less than 183 days in a country, you automatically become liable for tax. However, this is not the case. In the USA, for example, you become a tax resident if you spend more than 120 days in the country in a 3-year period.
