College Student Blows Twice the Legal Limit During DWI Traffic Stop

SARATOGA SPRINGS, NY - At 1:35AM on March 15th, 2020, Saratoga Springs Police pulled over an intoxicated driver for not having their headlights on while driving home. The driver admitted to drinking one or two mixed drinks earlier in the night. After processing the suspect's documentation, the officer ordered her out of the car to perform field sobriety tests. The suspect answered the officer's questions in full and indicated that she had no medical limitations that would prevent her from performing any of the tests.
During the horizontal gaze nystagmus test, the suspect was unable to follow the officer's pen smoothly and displayed distinct jerking movement at maximum deviation. The suspect was observed swaying throughout the exercise and was moving her head at times. For the walk-and-turn test, the suspect was unable to walk without placing her arms out to balance, pivoted while turning instead of taking small steps, and counted to 10 steps on her way back. The suspect apologized to the officer for going too far after the turn. During the one leg stand test, the suspect was unable to balance without her arms extended. While counting, the suspect repeated the number 14 twice and slurred her speech while reciting, "Mississippi," on more than one occasion.
Before administering the preliminary breath test, the suspect began crying during the officer's instructions. The suspect repeatedly apologized before blowing a .194% breath alcohol content (BrAC) which is over twice the legal limit to operate a motor vehicle in New York. Upon arrest, the suspect asked the officers to not contact her parents and admitted that her situation was her "fault." Shortly after, the suspect became hysterical while communicating to officers and continued to apologize. The suspect was subsequently charged with driving while intoxicated (DWI) and driving without headlights illuminated.
