Discrimination at work would be where you are treated less favourably then a comparator because of a protective characteristic.
Protective characteristics are your age, sex, race, religion, disability or sexual orientation. An act of discrimination can be dismissing you because of your protected characteristic, it could be a comment made to you which you found offensive, it could be the way an employer has dealt with a grievance or delayed with dealing with the matter.
The law offers protection for an employee if an employer was to treat you at a detriment or to dismiss you because of raising complaints or trying to bring a claim. You would be able to pursue a claim for victimisation.
A good practical tip for any employees who’ve been discriminated against is to keep good and detailed records of what’s happened. So I would suggest that you write down in a diary when it happened, who was present and what exactly was said. The more specific that you could be the more likely you are to succeed in any claim.
You can bring a discrimination claim whilst you are in employment and after you’ve left employment as well - as long as it is within the three months of the last act of discrimination. There may be previous acts which are out of time and it would be at the tribunal’s discretion as to whether to allow these claims in. Usually employees will go through internal complaints processes and these can be delayed due to a number of factors such as investigations, managers being away, employees being away. Usually the three month time limit will not stop during this appeal or grievance process and it’s therefore important for you to make sure you that you pursue any action within the necessary time periods.
There are various different steps that would need to take place in a discrimination claim. These would include a preliminary hearing and also witness statements and evidence and it’s important that you have expert legal advice to help you prepare for these and to put you in the best position to win your claim.
