As a spouse of a deceased veteran, you may be eligible for thousands of dollars in benefits from the VA, but to qualify you must prove that you are a spouse of a veteran.

There are a number of different ways in which you can do that.

In order to be considered a qualifying spouse, you must either be married to the veteran or be in what is called a “deemed valid marriage” to the veteran. “Deemed Valid” is determined by common law marriage standards regardless of whether you reside in a common law marriage state.

You can apply for DIC (Dependency and Indemnity Compensation) if you can prove these criteria:
1. Prove you were married to the deceased veteran or were in a "deemed valid" marriage
2. Had at least 1 year of marriage by the standards in #1
3. Continuously lived together during your marriage (except for medical or civil reasons that you'll have to explain)
4. You haven't remarried since the death of your veteran.

These criteria apply the same way to same-sex couples.
