The Lego Movie was so brilliant because it included such a wide array of characters from contemporary culture. Ironically the type of battle that the creators of the movie had to go through to get the legal rights to combine all of these characters is similar to the battle that the characters in the movie wage (i.e. master builders want to make mashups, but Lord Business forbids it).


Reasons this clip is fair use...
1. The purpose and character of the use - I am using this video to comment on trademark issues around both the making and content of the The Lego Movie.
2. The nature of the copyrighted work - The nature of the work is more artistic than factual but on balance the four factors weigh heavily in the direction of fair use.
3. The amount and substantiality of the portion taken - This clip is 74 seconds of an over 6,000 second movie.
4. The effect of the use upon the potential market - Negligible, no one is going to use this clip instead of purchasing, or viewing through other channels, this entire movie.
