Palko v. Connecticut | 302 U.S. 319 (1937)
Historians like to debate how much the framers of the Fourteenth Amendment sought to prevent states from encroaching on fundamental individual liberties. United States Supreme Court Justice Hugo Black believed that the amendment was specifically intended to make all of the Bill of Rights applicable to the states. But the Supreme Court never adopted Black’s approach. Instead, over more than a century and a half, one case at a time, the Court has incorporated almost all of the Bill of Rights to the states through the Fourteenth Amendment’s Due Process Clause. And in its 1937 decision in Palko versus Connecticut, the Court declined to incorporate an important criminal trial right.
Frank Palko and an accomplice broke into a music store in Bridgeport, Connecticut, and stole two radios. When police officers caught up to him, Palko shot them. Officer Wilfred Walker and Sergeant Thomas Kearney later died of their wounds.
Palko was charged with first-degree murder. A jury convicted Palko of second-degree murder, and he was sentenced to life imprisonment. The prosecution appealed, arguing that the trial judge erred in instructing the jury and admitting evidence. The Supreme Court of Errors of Connecticut agreed and ordered a new trial. The jury in the second trial convicted Palko of first-degree murder, and he was sentenced to be executed. The Supreme Court of Connecticut affirmed his conviction and sentence, and Palko appealed to the United States Supreme Court.
