Gordon v. State | 52 Ala. 308 (1875)
Ignorance of the law isn’t a defense to any crime. But what about ignorance of fact? In Gordon versus State, we’ll see whether a person could be found guilty of underage voting if he didn’t know his own age.
Gordon was an Alabama resident. Gordon’s mother and an acquaintance, who had known Gordon since his birth, frequently told Gordon that he would turn 21 years old in August of 1874. In November of 1874, Gordon voted in Alabama’s general election.
Under Alabama law, it was a felony for any person under 21 years old to vote in a state election. The state later discovered that Gordon wasn’t 21 when he voted in 1874.
The state charged Gordon with illegally voting in Alabama’s general election. At trial, Gordon’s mother and his acquaintance testified that they both told Gordon that he would turn 21 in August before the election. Gordon requested that the trial court provide the jury with instructions that Gordon should be found not guilty if the jury found that Gordon honestly believed, in reliance on the witness’ statements, that he was 21 years old when he voted. The court denied Gordon’s request, and the jury convicted Gordon. Gordon appealed to the Alabama Supreme Court.
