Examples of Misdemeanors

What makes a criminal charge a misdemeanor is the fact that the legislature does not allow for a hard labor sentence by the judge. However, most misdemeanors allow for jail time. Its just that the jail time for a misdemeanor would be served in a local parish jail rather than prison time in a state or federal prison for felony charges. In Louisiana, the determination of whether a charge is misdemeanor or felony is not based on the possible length of the sentence. Nevertheless, most misdemeanors carry up to six months in jail. Examples of misdemeanors are simple battery, simple assault, trespass, disturbing the peace, DWI first and second offense, simple possession of marijuana, shoplifting, and many more.
