How to File For Divorce in Minnesota

STEP 1 - Download the required Minnesota divorce papers - http://howtofilefordivorce.org/divorc...

STEP 2 - You must meet with your spouse in order to fill out the following forms:
   Petition for Dissolution of Marriage
   Summons
   Confidential Information Form
   Certificate of Representation
*If you receive financial assistance from the State or local authorities then you will have to fill out the Notice to County Support and Collections

STEP 3 - You must go to the court clerk's office in your county and submit the Summons and Petition for the Dissolution of Marriage.
The filing fee in the State of Minnesota is $400.
During the filing, attach a filed copy of the Petition for the Dissolution of Marriage to the Judgment and Decree of Dissolution and mark the Petition for the Dissolution of Marriage as Exhibit A.

STEP 4 - You will have to notify your spouse of the filing by sending him or her copies of the forms filed. The following forms you will need to send via Certified Mail Return Receipt Requested.
   Summons
   Petition for the Dissolution of Marriage
   Admission of Service ( You did not file this form with the clerk, but you need your spouse to complete this form and get it back to you.
   - Upon receiving the Admission of Service back from your spouse you will need to file the form with the clerk's office. -

STEP 5 - You will have to schedule a time to meet with your spouse and complete the following forms in agreement with each other:
   Marital Termination Agreement (if you own real estate then add the Real Estate Attachment)
   Judgment and Decree of Dissolution (fill this form out by copying the Marital Termination Agreement)

STEP 6 - In order to schedule a court hearing date, you will have to fill out the following form:
   Final Hearing Request
As well as file the following forms:
   Marital Termination Agreement (if you own real estate then add the Real Estate Attachment)
   Judgment and Decree of Dissolution
   Final Hearing Request
After filing you will have to send copies of all forms to your spouse.

STEP 7 - Attend your hearing, if you have completed all the follow steps the Judge should authorize your Judgment and Decree of Dissolution. This makes your divorce complete in the State of Minnesota.
