We all need to eat. But not that any of us, even lawyers, give all that much thought to the complex regulatory landscape which underpins the production, marketing and distribution of food worldwide, not to mention a host of related issues which ultimately affect all of us -- hence the fascination of this compendium of learned essays on the subject contained in this latest book from Edward Elgar.
Part of Elgar's 'Research Handbooks on the WTO' series, this is a collection of learned articles and essays from a multi-disciplinary team of fourteen practitioners and academics worldwide on the WTO (World Trade Organisation) Agriculture Agreement.
The book focuses on 'new' issues linked to the international regulation of agricultural production and trade, many of which, according to the editors, have either been insufficiently covered by the rules of the Agreement on Agriculture (AoA), or not quite adequately covered by existing literature. These are pressing problems nonetheless, as they pertain directly to international agricultural trade law, policy and regulation centering on matters of national food security, global climate change and biotechnology.
Many practitioners may not realize this (although many might well do) but, as the editors point out, the AoA effectively ended the era in which Agriculture was excluded from key principles of GATT, the General Agreement on Tariffs and Trade. The editors nevertheless, are of the view that 'members of the WTO are still not yet ready to treat agriculture in the same way as other products', even though they concede that the AoA's short term objective is to initiate a process of reform of trade in agriculture, while its long term aim is 'to establish a fair and market-oriented agricultural trading system.'
The range of topics covered in this volume is multi-faceted and various. Some of the papers deal with issues that are positively alarming; 'Do WTO rules improve or impair the right to food?' asks the paper from Christian Haberli at the World Trade Institute at Bern. Another paper by Michael Cardwell sheds interesting new light on the EU's Common Agricultural Policy. The essay by Graham Dutfield includes examinations of, for example, plant intellectual property and food security, focusing on the institutional and legal considerations and the need for reform.
These are only a few examples of course, of the wealth of research on agricultural trade law issues contained in this book. Practitioners with clients involved in agri-business will be particularly interested in the broad spectrum of matters discussed, as will trade negotiators, policy advisers and graduate students in this vital and fascinating field. The book is up to date as of 2012.
