The process is explained with a diagram I use regularly during my consultations. Affirmative Asylum process starts when the I-589 application is filed with the USCIS. Next step is the scheduling of the asylum interview. After the interview the asylum officer prepares the decision. The decision is either delivered in person or through mail. The favorable outcome is a decision granting asylum. If asylum is not granted then there are two possibilities depending on if applicant has other immigration status or not. If the applicant has other status at the time of decision, Asylum Office prepares a Notice of Intent to Deny. This gives the applicant the opportunity to respond. Asylum office may change its mind and issue a grant. If they don't, the application is denied. If the applicant does not have other immigration status, the asylum office refers the applicant to the immigration court by serving a Notice to Appear.
