The Union government can temporarily
The Union government can temporarily take control of or suspend mobile network in case of a public emergency.
This is one of the key provisions of the Telecommunications Bill 2023.
The draft bill was tabled in the Lok Sabha today by Union IT Minister Ashwini Vaishnaw amid heavy sloganeering by the opposition.
The bill was reportedly bcleared by the Union Cabinet in August
This bill aims to bring in a framework to replace three existing laws - the Indian Telegraph Act 1885, Indian Wireless Telegraphy Act 1933 and Telegraph Wires (Unlawful Possession) Act, 1950.
The bill aims to revamp the decades-old framework that governs the telecom sector.
Here are some of the major highlights of the bill.
The new bill also allows the government to intercept any messages between individuals in the interest of public safety.
As per the latest draft, messages from journalists with accreditation shall not be intercepted unless their transmission is prohibited under the national security clause
The Bill also says such unlawful interception may attract jail term of up to three years, a fine up to ₹ 2 crore or both.
An earlier version of this bill was put out for public consultation by the government in 2022.
Experts had raised concerns about the lack of privacy and possible surveillance that the proposed law may entail.
Among other provisions, the new bill empowers the government to waive off entry fees, licence fee, penalty etc. in the interest of consumers and national security.
Bahujan Samaj Party MP Ritesh Pandey opposed the introduction of the bill.
He said the draft bill violates the Supreme Court’s judgement that guarantees privacy as a fundamental right.
The bill was introduced through a voice vote despite opposition. The House was later adjourned for two hours.
