Honorable Supreme Court indicated the factors which should be taken care while granting an ex parte injunction.
2. Dalpat Kumar v. Prahlad Singh (1992), The Honorable Supreme Court stated that while granting or refusing to grant injunction, the court should exercise sound judicial discretion to find the amount of substantial injury which is likely to be caused to the parties. Moreover, no injunction could be granted against the owner at the instance of a person in unlawful possession.
