Under the FCRA -- Fair
Under the FCRA -- Fair Credit Reporting Act -- you only get to the $1,000 in statutory damages IF you prove willful or wanton/reckless conduct. If you do, then you can get punitive and statutory damages.
Remember to sue a furnisher for false credit reporting under the FCRA we need:
You -- Dispute to Consumer Reporting Agency -- Who notifies Furnisher -- Who then messes up the investigation.
If willful/reckless/wanton -- you can get actual damages, attorney fees, statutory damages and punitive damages.
If only negligent, then you get actual damages and attorney fees but NO statutory or punitive damages.
Have a great day!
