LEARN ABOUT THE APPLICATIONS FOR CONDONATION AT CCMA

Most of the disputes at the CCMA have prescribed time-periods attached to them. As a result of this, it is important that a dispute to the CCMA, which is linked to a prescribed time-period, is referred on time. The consequence of failing to comply with the prescribed time-period necessitates requirement to the apply for condonation.

An application for condonation is a detailed application, which is supported by an affidavit It needs to comply with rule 9 & 31 of the CCMA rules. Amongst other things, the application for condonation needs to deal with or address the following:

1. The degree of lateness;
2. The reason for the lateness;
3. Prospects of success; and
4. Prejudice.

Filing an application for condonation does not necessarily mean that it will be granted by the CCMA. The other party to the dispute will also be afforded an opportunity to file an opposition to the application for condonation. Therefore,  in order to avoid the requirement of making an application for condonation, it is important that parties refer the disputes to the CCMA on time.
