Here, we will discuss the applicability of capital gain tax on sale of shares –
As we know, under Income Tax, capital gain is levied in two types i.e. Short Term Capital Gain and Long Term Capital Gain.
In terms of sale of shares, in order to decide the applicability of Short Term Capital Gain and Long Term Capital Gain, we have to check the holding period of the shares. If the holding period of the shares is less than 12 months than Short Term Capital Gain is levied. Accordingly, if the holding period of the shares is more than 12 months than Long Term Capital Gain is levied.
Short term capital gain in case of listed equity shares is governed by the provisions of section 111A of the Income Tax Act. As per the provisions, if STT (Security Transaction Tax) is paid on such shares, Short Term Capital Gain will be taxable @15% on sale of listed equity shares.
On the other hand, Long term capital gain in case of listed equity shares is governed by the provisions of section 112A of the Income Tax Act. As per the provisions, Long Term Capital Gain of listed equity shares up to INR 1 Lakhs is exempt. Further, 10% capital gain tax is payable on Long Term Capital Gain on listed equity shares above INR 1 Lakhs. Notably, benefit of indexation is not available here.
It is important to note in case of Short Term Capital Gain other than shares, normal tax slab gets applicable. However, as per section 111A, in case of Short Term Capital Gain on listed shares tax @15% gets applicable.
Similarly, in case of Long Term Capital Gain in any other assets, 20% capital gain tax gets payable. However, as per section 112A, in case of Long Term Capital Gain on listed shares above INR 1 Lakhs tax @10% gets payable.
