As Orthodoxy does not follow such a legalistic approach, it is not surprising that it balks at the 1854 definition (called at the time by the ecumenical patriarch a"Roman novelty"). Ratzinger defended the tradition by appealing to the "sufficient freedom" of Mary's consent to the annunciation because she was not blocked by sin, and, therefore, by implication, free from original sin. Without full consent, he argues, the annunciation would have amounted to rape. Quite a shocking claim.
