Here's the scenario: You've been trying to come up with the perfect name for your business, and suddenly inspiration from the heavens hits you right upside the head. You have the perfect name! You know how you'll design the logo, and everyone is going to love it. You go online to look it up, and to your dismay, you see that Bob has a business with your perfect name...but he does not have a trademark registration.
