Under California business and professions code 17500 it is a crime to make a false, misleading, or otherwise incorrect claim or statement on any advertising. For the purpose of this criminal statute, an advertisement could appear in print such as a magazine, newspaper, label, or packaging on a product. It could appear in a digital ad such as a pop up on a website, or it could appear on television, radio, or any other form of media.
If convicted of this crime in California, it is a misdemeanor, with up to $2,500 in fines, and up to 6 months in jail. In addition to the California penalties, a company who is found responsible for false advertising could face lawsuits in civil court from consumers or competitors. They could also face prosecution from the consumer protection agency.
But there are defenses for those wrongfully charged with false advertising. It could be that the accusations of lies were incorrect, and the misleading statement is technically true. Or maybe the accused party had a good-faith belief that the statement was true, and unbeknownst to them it turned out to be incorrect. And if an advertising agency or marketing company came up with the false statement, and you had nothing to do with it, then you are not factually guilty of any crime.
