Personal bankruptcy can be a scary proposition, especially when it comes to unknowns. A common question I get from my clients has to do with budgeting. “If I file for bankruptcy, will every dime I spend be scrutinized? Will I be able to go to the movies or out to dinner?”
As I explain in this video, your budget will be scrutinized and we will have to cut out luxury and non-essential expenditures. However, you will not be expected to survive on bread and water, give up cable TV or your kid’s piano lessons.
The budget we file in your bankruptcy case must be reasonable, and the bankruptcy law gives us some guidance as to what reasonable monthly expenditures look like. Most filers see little or no difference in their day to day lives after filing bankruptcy.
Generally, your budget will not be our biggest problem when you file bankruptcy. The biggest problems usually arise when a bankruptcy filer wants to keep and pay for a big ticket item (house, car) that he/she really can’t afford.
I tell all of my bankruptcy clients that “if you are talking to a bankruptcy attorney, everything has to be on the table.” An experienced personal bankruptcy lawyer will guide you in creating a bankruptcy plan or course of action that reduces or eliminates debt, provides that you keep most or all of your property and helps you regain peace of mind.
