LEARN THE BASIC INTRODUCTION TO EMPLOYEE RELATIONS
The employment relationship is regulated by labour law. It is important for the parties to an employment relationship to understand the basic principles applicable in employee relations. As a starting point, it is important to note that in terms of South African labour law, only employees can be disciplined or dismissed. Therefore, as an employer, it is important to be able to identify an 'employee'. An employer cannot enforce discipline to anyone else but an 'employee'.
It is important to also note that South African labour law only prohibits UNFAIR dismissals and not dismissals. In other words, employers are allowed to dismiss provided that the dismissal is FAIR. In order for a dismissal to be fair, an employer needs to have a valid reason for the dismissal. In addition to the latter, the employer also needs to follow a proper process prior to dismissing an employee.
