The Court’s decision in Bush v Gore was in two parts. First, in a 7-2 Per Curiam opinion announced the day after arguments were made, Justices Stephen Breyer and David Souter joined the conservative justices and determined that the Florida decision violated the Fourteenth Amendment’s Equal Protection Clause, which states that no state shall “deny to any person within its jurisdiction the equal protection of the laws.” The Court claimed that Bush’s constitutional rights were violated since the standardless manual recount did not have legal precedent, therefore leading to “disparate treatment,” even if fair in theory. The Court then decided that a constitutional recount could not be done in time to satisfy federal election law. This vote, however, was 5-4, with the conservative justices in the majority and all liberal justices dissenting. However, the decision was also Per Curiam, meaning the holding was limited only to Bush v.
