LA County COVID-19 Tenant Protections Resolution: Phase 2 Hi, welcome to another tips for landlords and property managers video sponsored by Fast Evict Law Group.com. On today’s episode we’ll discuss phase 2 of the LA County COVID-19 Tenant Protections Resolution. Please remember, the contents of this video shouldn’t be considered legal advice. Please contact us if you have any questions. What is the LA County COVID-19 Tenant Protections Resolution? It was formerly known as the LA County Eviction Moratorium which originally went into effect in March of 2020. The resolution provides certain eviction protections to tenants in the LA County area who have been affected by COVID-19. Who is protected under the tenant protections resolution? The resolution covers residential, commercial and mobile home space tenants in unincorporated LA County as well as other cities in LA County that don’t have a moratorium in place of their own. Phase 1 - February 1, 2022 through May 31, 2022 What protections remain in place? Freeze on rent increases and other rent related fees for rent-stabilized units in LA County Landlord can’t evict for the following reasons: No fault reasons (except qualified owner move ins) Tenant causing nuisance Unauthorized occupants or pets Denying entry to the landlord for inspections or repairs Anti-harassment and retaliation protections for all tenants Personal guarantee protections for commercial tenants with fewer than 9 employees What protections are removed? Removes protections against eviction for non payment of rent for commercial tenants (as of January 31st, 2022) Phase 2 - June 1, 2022 through December 31, 2022 What protections remain in place? Freeze on rent increases and other rent related fees for rent-stabilized units in LA County Landlord can’t evict for the following reasons: No fault reasons (except qualified owner move ins) Tenant causing nuisance Unauthorized occupants or pets Anti-harassment and retaliation protections for all tenants Personal guarantee protections for commercial tenants with fewer than 9 employees Added as of July 1st, 2022: protections vs eviction for nonpayment of rent due to a COVID-19 financial hardship only apply to households with income at or below the 80% Area Median Income. What protections are removed? Tenant protections for denying entry to the landlord, except if the entry can be considered harassment or retaliation. Owner move ins: Removes the purchase date restriction (06/30/21) Removes restriction where the tenants mustn’t be financially impacted by COVID-19 for owner move-ins to qualify. Additional Information The Resolution does not cancel or stop the rent from being owed. Tenants and landlords are encouraged to work out a payment plan. Phase 2 protections are set to expire on December 31st, 2022 Residential tenants will have 12 months to repay past due rent after the expiration of the Resolution.
