On September 22, 2023, Secretary of Homeland Security Alejandro N. Mayorkas announced the extension and redesignation of Venezuela for Temporary Protected Status (TPS) for 18 months. This means that Venezuelans who were continuously residing in the United States before July 31, 2023, and who meet other eligibility requirements, may be eligible for TPS.

TPS is a humanitarian program that allows nationals of certain countries to temporarily live and work in the United States if their home country is experiencing ongoing armed conflict, environmental disaster, or other extraordinary and temporary conditions that prevent them from safely returning.

To apply for TPS, Venezuelans must file Form I-821, Application for Temporary Protected Status. The filing period for the new TPS designation for Venezuela has not yet been announced, but it is expected to begin in early 2024.

The extension and redesignation of TPS for Venezuela is a welcome relief for hundreds of thousands of Venezuelans who have fled their home country due to the ongoing political and humanitarian crisis. If approved for humanitarian parole, Venezuelans will be granted temporary permission to travel to the United States and live and work there for up to two years. They may also be eligible to apply for employment authorization and a Social Security number.
