Divorce through Mutual Consent can be obtained in situations where both the Husband and Wife agree to end their marriage under the same TERMS and CONDITIONS. If the couple has been living separately for a year or longer and both are willing to proceed with the divorce, they can mutually determine the terms of their separation, including matters such as Maintenance, Permanent Alimony, and Child Custody. Subsequently, they can jointly file a Divorce Petition under Section 13B of the Hindu Marriage Act with the relevant Family Court.
In contrast to a Contested Divorce, where spouses levy accusations against each other, Mutual Consent Divorce involves no allegations against either party; instead, "TEMPERAMENTAL DIFFERENCES" are cited as the reason for the divorce. The timeframe for processing a Mutual Consent Divorce petition typically ranges from 6 to 18 months. However, if the court waives the cooling-off period, the divorce can be granted in a much lesser time.
