Can I sue my lender for fraudulent foreclosure?

So your lender has committed fraud and wrongfully foreclosed on you.

Whether it's too late to do something about it or not depends on where you are.

If you're in Florida, they have judicial foreclosures where the lender has to go to court, sue you, and get a judgment against you.

In Alabama, we have non-judicial foreclosures. No judge presides over Alabama foreclosures. The mortgage companies say you're in default, they foreclose, and the advertise it the newspaper for 3 weeks.

Then some guy stands in front of the court house mumbling through the auction, and your house is sold.

I would say it's easier to take action in non-judicial foreclosure states like Alabama.

(I don't practice in places like Florida, though I am brought into cases in other states such as Florida.)

In judicial foreclosure states, if you haven't counter sued for fraud you may have lost your claim.

If you're in this situation, get with a consumer lawyer ASAP.
