In the previous video ( Police को FIR करनी पड़ेगी : FIR-first ... ) as per supreme court constitution Bench ruling in the case of Lalita Kumar vs State of UP (2013), Registration of FIR is mandatory and there is no preliminary inquiry is permissible in such a situation.
However, the same judgment has provided that in certain types of cases, preliminary inquiry may be allowed to be conducted, which will depend on the facts and circumstances of each case. See video ( NO INQUIRY BEFORE FIR- अब POLICE आपकी... )
In the third part of the video ( अगर Police F.I.R. ना करे तो क्या करें? ), various remedies have been outlined, if the police still refuse to register the FIR.
